Our Mission
The ISBAA endeavors to protect and serve the best interest of the commercial surety bail agents operating in Indiana by standing sentry over legislative efforts adverse to there interest. ISBAA has committed to promote professionalism, ethical behavior and education and to enhance the public perception of the bail industry in Indiana.
Our primary focus is to the future of bail in Indiana. We would like to see all Bail Agents join so we can have a united front and take on the challenges before us.
Cash bonds are closing in all around us. Many Bail Agents are not renewing their licenses. The Associations presence has been strong at the State House but we have been unable to convince the liberal law makers to restrict the use of cash and 10% cash bonds to nonviolent misdemeanors and D felony cases. However we have been able to strengthen bail laws to our benefit. The following are just a few:
• Eliminated annual filing of licenses and Qualifying Powers.
• Allowed the use of credit cards to pay premiums (veto override).
• Mandatory forfeiture of 10% cash deposit bonds.
• Persuaded State Board of Accounts to track cash bond forfeitures.
• Expanded forfeiture times from 180 days to 365 days.
• Changed annual filing of the 8/16 and 10/1 forms so that they are filed with license renewal.
• Created 90 day license reinstatement provision.
• Provide our voting members FREE continuing education.
• Invoked re-arrest bond on FTA to larger of original bond size or $2,500.
• Require courts to give legal written notice of FTA within thirty (30) days.
• Automatic 36 month bond expiration if no FTA or written legal notice within thirty (30) days.
• Exoneration possible if authorities fail or refuse to extradite defendant.
• Bond exonerated if defendant admitted or ordered to diversion program.
• Illegal aliens released only on full cash, property with two times the bail in net equity or corporate surety.
And there is certainly more.
We are still looking to restrict the use of cash bonds but it is exceedingly difficult especially with a short session coming up. However, we will be persistent and keep sending our message to the general assembly and to the public as well. One of our items of discussion will be on reducing our license fees and perhaps present it this upcoming session.
